Wills & Succession Planning

The importance of making a Will cannot be underestimated. The importance of making a Will that takes into account the potential for Inheritance Tax liabilities and at the same time making provision for dependents and beneficiaries, must also be carefully considered. The making of a Will can ensure that your wishes are carried out and can lessen the general anxiety experienced by friends and family after death. We understand the sensitivity that clients feel when making a Will. We frequently see people in their own homes if clients prefer not to call to the office and we will take time with you in preparing your Will.

We will consider the potential tax difficulties and may recommend that we engage with your Accountant or Financial Advisor to discuss aspects of Inheritance Tax and any other taxes we feel should be considered in respect of clients who wish to make provision for family members who are disadvantaged in any way. We are happy to advise further on their protection. From our experience making a Will can prevent any issues between beneficiaries arising in the future after your decease.

Administration of Estates

We understand the difficult time experienced by family and friends after the death of a loved one and we offer a very unobtrusive service concerning the administration of the deceased person’s estate. It is imperative to make contact with the executors very quickly to ensure the instructions of the deceased are carried out. We can share that burden by looking after the administration of estate and attending to very many different and difficult matters with a minimum of anxiety and stress to family and friends.

Administration of estates can sometimes take a little more than family and friends would generally expect. We are happy to explain exactly what we are doing at every stage to ensure that everyone is fully informed.

Family Matters

We have extensive experience with family matters including relationship breakdown. Relationship breakdowns have a dramatic affect on children and also the parties to the relationship. We understand the difficulties and stresses for both adults and children and we can assist you to resolve matters. Brian Scullion is a member of the Collaborative Law Group of Solicitors as some matrimonial issues can initially be dealt with by way of mediation. This however is not suitable for all parties. If required we can assist you further by taking matters to Court on your behalf in respect of residence or contact with your children, separation or divorce, relationship property involving occupation and ownership of the family home and other matters.

At all times we will endeavour to ensure that these matters are handled with the minimum of fuss and it is a priority of our practice in this area of Law. Where possible, we remove acrimony, anxiety and upset. We also offer 24 hour / 7 day legal services regarding children’s issues including, for example, Emergency Protection Orders and Children being taken abroad. Brian Scullion and Declan Green are also members of the Children Order Panel and in particular are on the Guardian ad Litem Panel of Solicitors. Nicola Burns also has a wealth of experience in dealing with the issues arising from relationship and matrimonial breakdown.

Criminal Matters

We provide a 24 hour / 7 day legal service to our clients if they are to be interviewed by Police or have been arrested. We can be contacted by Police if difficulties arise outside office hours. If you are arrested please immediately request PSNI to contact us.

PSNI have our contact numbers. It is important to note that legal advice and assistance from the Legal Services Commission can be made available at the outset and if you have been detained at a Police Station, free Legal Aid is available.

Litigation

If you have been injured at work, in a road traffic collision or elsewhere, we can discuss whether or not you may be entitled to lodge a claim for compensation. We are an experienced Litigation Firm and we are happy to discuss difficulties with you and advise you on the cost implications of litigation and advise you of any entitlement you may have to compensation. It could be that you may be entitled to cover from your insurance company, by Legal Services Insurance or even Legal Aid provided by the Legal Services Commission.

Our initial 30 minute interview is free and again we can consult with you in the office, at home or in fact at hospital if you require. We have a wealth of experience in Plaintiff and Defence litigation. We also have expertise in hearing loss cases and medical/professional negligence claims.

Commercial Services

We provide many services to our commercial clients and we recognise the difficulties faced by many businesses today in our very heavily regulated world, particularly small businesses. We provide advice to many businesses (partnerships and companies) and in particular advice relating to business property, the sale and/or purchase, leasing/renting, commercial contracts with clients suppliers, existing employment legislation and health and safety, commercial litigation.

We also deal with Liquor Licensing and Bookmakers’ licensing matters.

Employment

Whether you are an employer or employee we can provide you with the advice on your contracts and the many issues that arise out of contracts of employment.

We can also represent you at Industrial Employment Tribunals or Equality Tribunals.

Liquor Licensing Law

We have represented many local businesses over the years involved in the liquor licence trade. We have experience in advising clients of their duties and requirements under current liquor licensing laws.

We advise clients on the legal processes involved in obtaining, transferring and protecting liquor licences.

Judicial Review

Judicial Review is a developing area of law in this modern age. Judicial Review is a type of Court Proceeding in which a Judge reviews the lawfulness of a decision, act or omission by a public authority. We have been involved in a substantial number of Judicial Reviews where our clients have successfully challenged the lawfulness of a decision, act or omission of a public authority.

A public authority includes (but is not limited to) Health Trusts, Education Boards, Universities, the Planning Service. We are more than happy to discuss any potential case you may have with a decision taken by a public authority which affects you.

Appointments

We provide appointments during and outside office hours. Appointments outside office hours are by arrangement. We are happy to see you at a time, date and location that is convenient for you including at your home, office or any other place you feel is appropriate. For clients with physical impairments we offer home visits or downstairs consultation rooms. We have dedicated car parking for clients with physical impairment - please let us know if you require this service.
